These Terms and Conditions ("Terms") govern your access to and use of the Fogo Wallet application and website at fogowallet.xyz (collectively, the "Service"), operated by BakersLabs Ltd, a company registered in England and Wales (Company Number: 16920720), with its registered address at 86-90 Paul Street, London EC2A 4NE, England ("Fogo," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old to use the Service. By using Fogo, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. You further represent that you are not located in, or a resident of, any jurisdiction where the use of the Service would be prohibited by applicable law.
Nature of the Service
Fogo is a non-custodial wallet interface for interacting with public blockchain networks. This means:
We never hold, control, or have access to your private keys, seed phrases, or digital assets.
You retain full ownership and responsibility for your wallet and all transactions you initiate.
We do not execute, intermediate, or settle any transactions on your behalf.
We are not a bank, exchange, broker, financial institution, or money services business.
Fogo provides a software interface only. All transactions are executed on public blockchain networks and processed by their respective decentralized protocols.
Risk Warnings
Cryptoassets are unregulated and high-risk. You could lose all funds invested.
By using the Service, you acknowledge and accept the following risks:
The value of cryptoassets is highly volatile and may fluctuate significantly, including to zero.
Blockchain transactions are irreversible. Fogo cannot recover lost, stolen, or incorrectly sent assets.
If you lose access to your private keys or seed phrase, your assets are permanently unrecoverable. We cannot help you recover them.
Smart contracts and decentralized protocols may contain bugs, vulnerabilities, or be subject to exploits.
Regulatory changes in any jurisdiction may adversely affect the use, transfer, or value of cryptoassets.
Network congestion, outages, or failures may delay or prevent transactions.
You are solely responsible for evaluating the risks associated with your use of the Service and any transactions you conduct.
Wallet Connection and Security
You may connect an existing wallet (such as Phantom) to Fogo. You are solely responsible for maintaining the security and confidentiality of your private keys, seed phrases, and wallet credentials. Fogo does not store or have access to this information.
You agree to immediately notify us if you suspect any unauthorized use of the Service in connection with your wallet.
Swap Functionality
The Service provides an interface to third-party decentralized exchange protocols for swapping digital assets. When using this feature:
Fogo acts solely as a user interface. We do not custody assets, execute trades, or act as a counterparty to any transaction.
Swap rates, fees, and slippage are determined by the underlying protocols, not by Fogo.
You are responsible for reviewing and accepting the terms of any transaction before confirming it.
Transaction costs may be reduced where supported by the network, but this is not guaranteed.
Fees
Fogo does not currently charge fees for using the Service. This may change in the future, and we will notify you of any fee changes before they take effect. Network fees (gas fees) charged by blockchain networks are not controlled by Fogo and are your responsibility.
Prohibited Uses
You agree not to use the Service to:
Violate any applicable law, regulation, or third-party rights.
Engage in fraud, money laundering, terrorist financing, or any other financial crime.
Circumvent sanctions or trade restrictions imposed by any governmental authority.
Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure.
Use automated systems, bots, or scripts to interact with the Service in a manner that degrades its performance.
Reverse engineer, decompile, or disassemble any part of the Service.
We reserve the right to restrict or terminate your access to the Service if we reasonably believe you are engaging in prohibited use.
Intellectual Property
All content, branding, design, code, and materials associated with the Service are the property of BakersLabs Ltd or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
Third-Party Services
The Service may interact with or link to third-party services, protocols, and applications. These third parties have their own terms and privacy policies. Fogo does not endorse, control, or assume responsibility for any third-party services. Your use of third-party services is at your own risk.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any information provided through the Service.
Limitation of Liability
To the fullest extent permitted by applicable law, BakersLabs Ltd, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or digital assets, arising out of or in connection with your use of the Service.
Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the amounts you have paid to us (if any) in the twelve months preceding the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.
Indemnification
You agree to indemnify, defend, and hold harmless BakersLabs Ltd and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party rights.
Modifications
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree with any changes, you should stop using the Service.
Termination
We may suspend or terminate your access to the Service at any time, without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately. Any provisions of these Terms that by their nature should survive termination will continue to apply.
Your assets remain in your wallet and under your control regardless of whether your access to the Service is terminated.
Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BakersLabs Ltd regarding your use of the Service, and supersede any prior agreements or understandings.
